Terms of Use — Drive100

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Drive100 mobile application ("App").

The App is developed and provided by YingHan Gao ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Eligibility

You must be able to form a legally binding agreement in your jurisdiction to use the App.

If you are under the age of majority, you must have permission from a parent or legal guardian.

The App is not intended to provide legal, professional, or certified driving instruction.

3. The App and Services

Drive100 is an educational tool designed to help users practice and review driving theory questions (including road rules, signs, and scenario-style questions).

The App operates primarily offline. Your learning progress and settings are stored locally on your device.

Drive100 is not affiliated with the SAAQ (Société de l’assurance automobile du Québec) or any governmental authority.

4. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial learning purposes, subject to these Terms.

You agree not to:

• Copy, reproduce, distribute, republish, or publicly display any App content (including questions, images, and explanations) except as permitted by law
• Reverse engineer, decompile, modify, or attempt to extract the App’s source code (except to the extent permitted by applicable law)
• Use the App for illegal, harmful, or unauthorized purposes
• Sell, sublicense, rent, lease, or exploit any part of the App or its content
• Interfere with or disrupt the App or any third-party services integrated into the App

5. Educational Disclaimer

The App and its content are provided for educational and practice purposes only.

We do not guarantee that the content is accurate, complete, current, or aligned with any official SAAQ exam or requirements.

Using the App does not guarantee that you will pass any driving theory exam.

6. Third-Party Services

The App may rely on third-party services to provide certain features, including advertising and subscription management.

Third-party services may collect or process information in accordance with their own policies. We do not control and are not responsible for third-party services’ practices.

Your use of third-party services is subject to their terms and privacy policies.

7. Subscriptions and In-App Purchases

The App may offer optional subscription features.

Subscriptions are offered through the platform store (such as the Apple App Store or Google Play Store) and are governed by the store’s terms in addition to these Terms.

• Billing: Payment is charged to your Apple ID or Google account at confirmation of purchase, depending on the platform you are using.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, as determined by the platform store.
• Manage or cancel: You can manage or cancel your subscription at any time through your App Store or Google Play account settings.
• Uninstalling the App does NOT cancel your subscription. You must cancel through your store account settings to avoid future charges.
• Platform responsibility: Apple and Google are not responsible for the App’s content or functionality.

8. Refunds

All payments are processed by the platform store (such as the Apple App Store or Google Play Store).

Refund requests must be submitted directly through the applicable platform store and are subject to the store’s refund policies and applicable consumer protection laws.

We cannot issue refunds independently or override decisions made by the platform store.

9. Intellectual Property

All content in the App—including but not limited to:

• Practice questions
• Scenario images and illustrations
• Explanations and descriptions
• App design, layout, and user interface
• App name and logo

—is the exclusive property of YingHan Gao and is protected by applicable copyright and intellectual property laws.

You receive no ownership of the content. You may not copy, modify, distribute, or reuse the content without written permission.

10. No Warranties (“AS IS”)

The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, either express or implied.

We do not guarantee that the App will be error-free, uninterrupted, secure, or available at all times.

We do not guarantee that third-party services (including ads or subscription validation) will operate without interruption.

11. Limitation of Liability

To the fullest extent permitted by law, YingHan Gao will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from or related to your use of the App.

Your use of the App is at your own risk.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

12. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless YingHan Gao from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms.

13. Changes to the App or Terms

We may update, change, suspend, or discontinue the App (in whole or in part) at any time.

We may also update these Terms from time to time. Your continued use of the App after changes become effective means you accept the updated Terms.

14. Termination

We may suspend or terminate your access to the App if you violate these Terms.

You may stop using the App at any time by uninstalling it.

15. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the courts located in Quebec, Canada, except where prohibited by applicable consumer protection laws.
